1. Acceptance of Terms

By accessing or using the Frasa application and website (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Frasa is a collaborative writing platform that provides AI-powered writing tools, a rich text editor with real-time collaboration, mind mapping, scribble canvas, and publishing features. The Service is available via web browser, desktop application, and mobile application.

3. User Accounts

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.

4. Subscriptions and Payments

Frasa offers auto-renewable subscription plans that provide access to premium features. By purchasing a subscription, you agree to the following terms:

  • Subscription Plans: Frasa offers monthly and yearly subscription plans. The specific features, pricing, and duration of each plan are displayed at the time of purchase.
  • Payment: Payment will be charged to your Apple ID account (for iOS purchases) or your selected payment method (for web purchases) at confirmation of purchase.
  • Auto-Renewal: Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current subscription period.
  • Renewal Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price as the original subscription, unless you have changed your subscription plan.
  • Managing Subscriptions: You can manage and cancel your subscriptions by going to your Account Settings on the App Store (for iOS purchases) or through the Frasa billing settings (for web purchases) after purchase.
  • Free Trials: Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
  • Price Changes: Prices for subscriptions are subject to change. We will notify you of any price changes in advance, and you will have the opportunity to cancel before the new price takes effect.

5. User Content and Ownership

You retain full ownership of all content that you create, upload, or share through the Service ("User Content"). By using the Service, you grant Frasa a limited, non-exclusive license to store, display, and process your User Content solely for the purpose of providing the Service to you. We do not claim ownership of your User Content, and you may delete it at any time.

6. AI Features and Data Processing

Frasa integrates AI-powered features using third-party services (including OpenAI and Google Gemini). When you use these features, portions of your content may be sent to these third-party services for processing. You can control which AI features are enabled in Settings. Please refer to our Privacy Policy for full details on data processing by third-party AI services.

7. Prohibited Uses

You agree not to use the Service to:

  • Violate any applicable law or regulation.
  • Infringe upon the intellectual property rights of others.
  • Upload or share content that is harmful, threatening, abusive, defamatory, or otherwise objectionable.
  • Attempt to gain unauthorized access to the Service or its related systems.
  • Use the Service for any commercial purpose not expressly permitted by these Terms.

8. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Frasa and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Frasa.

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. Frasa does not warrant that the Service will be uninterrupted, secure, or error-free.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Frasa, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

11. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these Terms. If you wish to terminate your account, you may do so through your account settings. All provisions of these Terms which by their nature should survive termination shall survive termination.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of Indonesia, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
